Validity:

For the provision of services by Kittenberger Gartenchalets GmbH (hereinafter also referred to as accommodation provider), these general terms and conditions apply exclusively. Unless otherwise regulated in these GTC, the Austrian Hotel Contract Terms and Conditions (AGBH 2006) published by the Professional Association of the Hotel Industry (1045 Vienna, Wiedner Hauptstraße 63) apply subsidiarily. These can be obtained, viewed or ordered electronically at bit.ly/3Ht5Hky. Terms and conditions of the guest - uniform designation for the contractual partner (customer/guest/organizer, etc.) - shall not become part of the contract even if they are not expressly contradicted.
 

Conclusion of contract, down payment:

The contracting parties are the accommodation provider and the guest (individual guest, tour operator or private travel groups). The accommodation contract is concluded by the acceptance of the written or verbal order of the guest by the accommodation provider, whereby the present General Terms and Conditions are exclusively taken as a basis, which is also expressly acknowledged by the guest or organizer through the actual use of the respective service. It can be agreed that the guest makes a down payment. The Proprietor may also demand advance payment of the entire agreed fee.


Arrival and departure:

Booked chalets are available to the guest from 15:00 on the day of arrival and until 10:30 on the day of departure. The determination of the chalets to be allocated to the guest is made by the hotel on the day of arrival. Unless a later arrival has been expressly agreed, the Proprietor shall have the right to assign booked chalets to other parties after 6:00 p.m. without the Guest being able to derive any claims for compensation therefrom. In this respect, the accommodation provider is entitled to a right of withdrawal. However, if the guest has "guaranteed" arrival and/or paid a deposit, the chalet(s) shall remain reserved until 10:30 a.m. of the following day at the latest. If a chalet is used for the first time before 8:00 a.m., the previous night will count as the first night.

The guest must, in case of a scheduled departure after 10:30 a.m., inform the reception at the latest by 10:00 p.m. the day before departure; in case of a departure before 6:00 p.m., half the chalet price must be paid, after 6:00 p.m. the full chalet price must be paid.


Prices:

Prices are determined according to the price list valid at the time of service provision. As far as legal value added tax is applicable, it is included in the prices. The local tax is not included in the prices and will be charged on site.

Any increase in these taxes and fees after the conclusion of the contract shall be borne by the guest.


Terms of payment:

All invoices of the accommodation provider are due for payment without deduction upon departure of the guest or presentation of the invoice. Payment can be made in cash, by ATM card or by credit card.

In any case, the Proprietor may require the Guest to make an advance payment of a reasonable amount. If the aforementioned payment deadline is exceeded, the guest shall be in default without the need for a reminder. In case of default, § 1333 ABGB (Austrian Civil Code) shall apply to mutual business transactions. A reminder fee may be charged in each individual case for reminders sent after the default has occurred.


Withdrawal and cancellation:

In the event of force majeure and other impediments for which the Proprietor is not responsible, in particular those outside the Proprietor's sphere of influence, the Proprietor reserves the right to withdraw from the contract without the Guest being entitled to any compensation claims. Unless otherwise agreed, the following cancellation conditions apply to the guest/organizer. We would like to point out that in the case of accommodation contracts concluded by means of distance selling, there is no right of withdrawal within 14 days from the conclusion of the contract, but our cancellation conditions stated in the confirmation or subsidiarily in these GTCs apply.


Cancellation conditions:

up to 60 days before the arrival day free of charge;

up to 1 month before the arrival date 40% of the total cost of the stay;

up to 1 week before the arrival date 70% of the total cost of stay;

in the last week before the arrival day 90% of the total cost of stay;
Cancellations on the day of arrival or no-shows 100% of the total cost of stay.

 

Non-refundable rate:
This is no longer a free cancellation option after a booking has been made. The amount for the entire booking must be paid immediately upon reservation and is non-refundable.


Travel Insurance Coverage:
To avoid costs and hassle in case of cancellation or early departure, but also for more security on your Austrian vacation, the accommodation provider recommends taking out travel cancellation insurance with Europäische Reiseversicherung Link: Hotel Cancellation Plus - Europäische Reiseversicherung (europaeische.at).
 

Liability:
The Proprietor shall endeavor to ensure the punctuality of wake-up orders, timely and correct transmission of messages and delivery of goods shipments of all kinds. However, the accommodation provider is only liable for these business errands if the accommodation provider or his employees are guilty of gross negligence. Lost property, in particular items left behind in the chalet by the guest (insofar as these are not obviously worthless), shall only be forwarded at the request, risk and expense of the guest. After the expiry of a one-year storage period, the lost property shall be deemed to have been disposed of. Therefore, after the expiration of this year, the accommodation provider may dispose of these items as he sees fit, or even destroy them.
 

The accommodation provider shall only be liable for property damage suffered by a guest if the property damage occurred within the scope of the business and the accommodation provider or its employees are guilty of gross negligence.

The Proprietor shall only be liable for objects brought in up to the respective statutory maximum amount. The safekeeping of valuables, money and securities may be refused if the items in question are considerably more valuable than guests of the Proprietor usually leave in safekeeping. Otherwise, valuables shall be deposited in the room safe.

The Proprietor shall provide the Guest with a car parking space free of charge. This does not constitute a safekeeping contract. In case of loss or damage to motor vehicles parked or maneuvered on the property and their contents, the Proprietor is not liable, except in case of intent or gross negligence.


General:

Subletting or reletting, as well as the use of chalets for other than residential purposes is not permitted and requires the prior written consent of the hotel.

An extension of the stay by the guest requires the consent of the accommodation provider.

The Proprietor points out that from 22:00 o'clock to 07:00 o'clock the night rest is to be kept. No parties or celebrations are allowed. The guest is fully liable for any damage caused by the guest in the chalet, in the associated gardens, wellness facilities and in the entire chalet area.
 

The place of performance and the exclusive place of jurisdiction for all disputes arising out of the

accommodation contract is, as far as permissible (§14 KSchG), Krems. Austrian law is exclusively applicable.
